Welcome to Opening Day. These Terms of Service (“Terms”) are a legal agreement between you and Opening Day (“we,” “us,” or “our”) that govern your use of openingdaykit.com and anything you buy from us. Please read them carefully.
1. Acceptance of Terms
By using openingdaykit.com, creating an account, or buying one of our kits, you agree to these Terms. If you don’t agree, please don’t use the site or buy our products.
You need to be at least 18 years old (or the age of majority in your state) to buy from us. By purchasing, you’re telling us you meet that age requirement.
2. What We Sell
Opening Day sells digital products for hospitality entrepreneurs — things like PDFs, spreadsheets, Canva templates, checklists, and guides. Each kit is delivered as a digital download after purchase. There are no physical goods and nothing gets shipped.
3. Pricing and Payment
Prices are listed in US dollars on the product page. We may change prices at any time, but changes won’t affect purchases already completed. Payment is handled by a third-party processor (Stripe or similar). You’re responsible for any applicable sales tax based on your location.
4. Delivery
After your payment is confirmed, you’ll get an email with your download link or access instructions. Delivery is usually immediate or within a few minutes. If you don’t receive your download within 24 hours, check your spam folder, then email dustin@engageflow.co and we’ll sort it out.
5. Refund Policy — 30-Day Money Back Guarantee
We stand behind our kits. If you’re not happy with your purchase for any reason, email dustin@engageflow.co within 30 days of the purchase date and we’ll issue a full refund. No questions asked. After a refund, your license to use the product ends. Refunds are issued to the original payment method and may take a few business days to appear.
6. License — What You Can and Can’t Do
When you buy a kit, you get a personal, non-exclusive, non-transferable license to use it for your own hospitality business.
You CAN: Use the templates for your own business (one business per license), customize them with your branding, print them for internal use, and share individual files with your own employees or business partners.
You CAN’T: Resell, redistribute, or give away the files. Share them publicly or upload them to file-sharing sites. Use them to create a competing product. Claim you created them. Remove copyright notices.

7. Accounts
If we offer accounts on openingdaykit.com, you’re responsible for keeping your login information secure. Don’t share your password. You’re responsible for everything that happens under your account.
8. Prohibited Uses
You agree not to use the site or products for anything illegal, try to hack or disrupt the site, scrape or copy content without permission, impersonate anyone, upload viruses or malware, or use automated tools that overload our servers.
9. No Guarantees About Business Success
Our kits give you tools, templates, and guidance — they don’t guarantee your business will succeed. Running a hospitality business involves risk. Nothing we sell should be treated as legal, financial, tax, or accounting advice. Talk to qualified professionals for decisions that need professional input.
10. Limitation of Liability
To the maximum extent allowed by law, our products and site are provided “as is” without warranties of any kind. We’re not liable for any indirect, incidental, consequential, special, or punitive damages. Our total liability for any claim is limited to the amount you paid us for that product in the 12 months before the claim.
11. Indemnification
You agree to defend, indemnify, and hold Opening Day harmless from any claims, damages, or expenses arising from your misuse of the site or products, your violation of these Terms, or your violation of someone else’s rights.
12. Termination
We can suspend or terminate your access if you break these Terms. You can stop using the site and products anytime. Sections about intellectual property, limitations of liability, indemnification, and governing law survive termination.
13. Governing Law
These Terms are governed by the laws of the United States. If we have a dispute, we’ll try to work it out informally first — email dustin@engageflow.co. If we can’t resolve it, any legal action must be brought in the courts where Opening Day is based.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll change the “Last Updated” date at the top. Continuing to use the site after changes means you accept the new Terms.
